Another Moronic Foreclosure Defense Lawyer Bites The Dust! Florida Lawyer Bruce Jacobs Permanently Disbarred!

The Florida Supreme Court permanently disbarred foreclosure lawyer Bruce Jacobs last week. Justices also took an extraordinary step. They enhanced the punishment that Miami-Dade Circuit Judge Betsy Alvarez-Zane called for in her referee report.

Alvarez-Zane’s report found that Jacobs committed serious misconduct that included filing frivolous pleadings and claims or contentions. She also found he lacked candor toward the tribunal. In addition, she said Jacobs knowingly disobeying the orders or rules of the tribunal. Alvarez-Zane also stated Jacobs impugned the integrity of judicial officers without an objective basis in fact.

Alvarez-Zane referenced five cases or counts in her report. She noted each of which pertained to Jacobs’ particular brand of advocacy in foreclosure defense cases. Jacob’s advocacy had seen sharp pushback from the Third District Court of Appeal. In one case, Jacobs claimed to be a “victim of the Third DCA’s abuse of its contempt powers”

The Justices also explained the accusations Jacobs raised against financial lenders when they suspended him in June 2023. The justices characterized him as a “veteran foreclosure defense attorney” who developed a “set of legal theories.”

Jacobs based his theories on the concept on the premise that:

“A party seeking to foreclose on a defaulted mortgage should not be able to collect an equitable remedy if it came to the court with unclean hands.”

Jacobs frequently argued that the note holder should not be allowed to enforce the note or foreclose on the mortgage:

“If any faulty or defective assignments occurred after the closing on the note and mortgage.”

However, the Court clarified that it was not Jacobs’ legal theories that ultimately led to his disbarment.

Jacobs told the 3DCA he was fighting the “modern-day monopoly” against the mortgage industry.

He called on, “All the patriots who swore the oath to protect and defend the Constitution” to join him.

He also stated:

“Any court that protects the monopoly over the rule of law is a traitor to the Constitution, and should be tried for treason.”

Alvarez-Zane also found that Jacobs wanted to play Don Quixote. She stated Jacobs made it his mission to hold mortgage lenders’ feet to the fire for alleged foreclosure abuse. He also employed an abusive Mark Stopa trial tactic to disqualify trial judges. Stopa was disbarred in 2019.

Judge Alvarez-Zane wrote:

“In both motions, respondent continued his familiar pattern of making scandalous accusations against the court, without an objective basis in fact to support the same, However, in these two motions, respondent escalated his misconduct to include racial slurs, in a reprehensible act of race-baiting.”

She points out one of Jacobs’ particularly disturbing scandalous accusations made against a judge:

“It is shocking that an experienced African American judge would openly and flagrantly violate the Klu Klux Klan Act of 1871. It is illegal to deprive [my client] of his constitutional rights under color of law.”

Alvarez-Zane wrote that Jacobs’ “scandalous allegations achieved the desired result” as the judge disqualified himself.

Judge Alvarez-Zane also stated:

“He invoked the spectra of Nazis on numerous occasions. All these improper appeals to emotion and inflamed passions are a bad faith trial tactic, designed to prejudice the trier of fact in the case in the act of despicable gamesmanship.”

Now, the state Supreme Court has approved the referee’s findings of fact. As a result, they accepted the referee’s recommended sanction of disbarment with a two-page order.
