Miami Judge Reverses Romspen Foreclosure Against Caroline Weiss. Judge Refers The Case To Mediation.
A Miami judge has reversed the Romspen foreclosure against Caroline Weiss and her 7 At Blue Lagoon properties. The reversal also affects the foreclosure on her private home in Miami. As result, it appears Weiss’ attorney may have even saved the properties from the jaws of foreclosure.
Weiss’s good fortune is bad news for the financially strapped Canadian lender. Romspen is in serious financial trouble. The company is holding over $1.5 Billion in non-performing loans. Word on Wall Street and Toronto is that Romspen may not survive to see 2026.
In July 2024, the 11th Circuit Court in Miami ruled in favor of Romspen in their foreclosure lawsuit against Weiss. However, Romspen’s victory was short lived. Judge Thomas Rebull reopened the case due to a serious flaw in Romspen’s foreclosure complaint.
Weiss’ attorney argued that the foreclosure litigation was invalid because language in the mortgage documents say both sides agreed to binding arbitration in the event of a dispute.
It also appears Romspen’s lawyers knew about the arbitration clause but chose to ignore it. Romspen initiated the foreclosure action anyway hoping no one would notice. Thus, they could get their hands on the 7 At Blue Lagoon properties faster. The plan was then to flip the parcels at a sizeable markup to pay Romspen’s enormous debt load.
Unfortunately for Romspen, Weiss’s attorney and the court discovered Romspen desperate ruse in January before it was too late. Rebull reversed the judgment and referred the dispute to mediation.
