Yes, some of them make you scratch your head and wonder if Darwin was right. One desperate Brooklyn homeowner pulled a creative but illegal tactic. The Brooklyn man invented a fake church to slap a lien on his own house. This bizarre scheme aimed to halt an impending foreclosure. However, it quickly unraveled. His misguided opinion was “A bank won’t foreclose on God!”

Liens often serve as legal and legitimate claims on assets by contractors and lenders. Here, the fabricated church lien was designed to complicate the title and stop a foreclosure. In theory, this could buy time for a few months or even years in a Kings County court. However, at the end of day all the futile stunt did was create more problems for the Brooklyn homeowner. 

How the Scheme Unraveled

Banks and title companies routinely scrutinize suspicious liens. During the foreclosure process, the lender’s attorneys discovered what the Brooklyn homeowner did. It was pretty obvious and the homeowner’s signature was all over the quit claim deed to the “church.”

New York law requires liens to stem from genuine debts or services. However, in this case, the homeowner created a fake lien. Thus, he committed fraud.

The lender’s attorneys quickly identified the homeowner as the sole “officer” of the phantom church. Now, he faces another reason for the bank to accelerate the foreclosure. He violated the terms of his foreclosure. All foreclosures ban homeowners from transferring or selling the property without the written consent of the lender while there is an active mortgage lien on the property. He could also now face criminal charges including filing false documents and attempted fraud.
